June 3 – France’s FC Nantes and Ismael Bangoura will have to pay Dubai’s Al Nasr Sports Club €4.5 million after the Court of Arbitration for Sport (CAS) rejected their appeal and upheld a FIFA sanction from November of last year.
In their appeal the French club and the player argued that the breach of contract was justified and that the sanctions should be lifted. However, CAS ruled that there had been a unilateral termination of the contract, without just cause, during a protected period.
The original FIFA sanction had included a four month suspension for the Guinean player Bangoura and a ban on FC Nantes registering any new players for the next two transfer windows. These sanctions were also kept in place.
Al Nasr Sports Club had also appealed to CAS requesting that the amount of compensation be increased, however CAS also overruled this appeal.
The CAS panel was comprised of Prof. Martin Schimke (Germany), President of the Panel, Mr Manfred Nan (Netherlands) and Prof. Luigi Fumagalli (Italy). The grounds for the decision of the panel will communicated at a later date.
